Certificates of Occupancy

Council, pursuant to Regulation 83 of the Development Regulations, 2008, on receipt of an application will issue a certificate of occupancy:

1.In the case of a Class 1 building under the Building code

 - within two business days form the day the required documentation is received by Council subject to the application being accompanied by the following documentation:

a.A written statement from any licensed builder who was responsible for
undertaking any part of the building work that the building work has been carried out in accordance with any relevant approval.

b.A written statement from any licensed builder who was responsible for
undertaking any part of the building work that the connections required to any

i. public electricity source; or
ii. public water supply; or
iii. public sewer; or
iv. septic tank effluent drainage system; or
v. public telecommunications system; or
vi. other service or facility provided by a public authority or utility;

have been made in accordance with the requirements of the relevant authority or utility.

c.A copy of the builder's licence.
d.Payment of the appropriate fee.

2.In the case of a Class 2 to 9 building under the Building Code

 - within five business days from the day the required documentation is received by Council subject to the application being accompanied by the following documentation:

a.A written statement from any licensed builder who was responsible for undertaking any part of the building work that the building work has been carried out in accordance with any relevant approval.

b.A written statement from any licensed builder who was responsible for undertaking any part of the building work that the connections required to any

i. public electricity source; or
ii. public water supply; or
iii. public sewer; or
iv. septic tank effluent drainage system; or
v. public telecommunications system; or
vi. other service or facility provided by a public authority or utility;

have been made in accordance with the requirements of the relevant authority or utility.

c.A copy of the builder's licence.

d.Payment of the appropriate fee.

e.In the case of a building in which essential safety provisions are installed or required to be installed, inspected, tested or maintained under the Building Code

i. a certificate of compliance for each safety provision signed by the installer; and

ii. a plan of the building that has marked on it the location of each essential safety provision installed in the building.

3.In the case of a building that is required by the Building Rules

a.to be equipped with a booster assembly for use by a fire authority; or

b.to have installed a fire alarm that transmits a signal to a fire station; and

c.facilities for fire detection, fire fighting or the control of smoke must be installed in the building pursuant to an approval within 20 business days from the day the required documentation is received by Council;.

4.In the case of owner builders of a Class I building under the Building Code

 - within two business days from the day the required documentation is received by Council subject to the application being accompanied by the following documentation:

a.A written statement from each contractor associated with the building that the particular phase of work undertaken has been carried out in accordance with any relevant approval.

b.If there are no contractors involved with the construction a certificate from a person with prescribed qualifications advising Council that the work has been carried out in accordance with any relevant approval.

c.Payment of the appropriate fee.

5.In the case of a building involving novel or complex forms of construction

 - within five business days from the day the required documentation is received by Council subject to the application being accompanied by the following documentation:

a.A written statement from any licensed builder who was responsible for undertaking any part of the building work that the building work has been carried out in accordance with any relevant approval.

b.A written statement from any licensed builder who was responsible for undertaking any part of the building work that the connections required to any

i. public electricity source; or
ii. public water supply; or
iii. public sewer; or
iv. septic tank effluent drainage system; or
v. public telecommunications system; or
vi. other service or facility provided by a public authority or utility;
v. public telecommunications system; or
vi. other service or facility provided by a public authority or utility;

have been made in accordance with the requirements of the relevant authority or utility.

c.A copy of the builder's licence.
d.A certificate from an independent technical expert that the particular form of construction complies with the Building Code.
e.Payment of the appropriate fee.

6.In the case of a development approved subject to conditions

 - within five business days subject to a statement from the licensed builder associated with the building or a person with prescribed qualifications that the conditions have been satisfied.
